Thailand is cracking down nationwide on illegal nominee shareholders used to conceal foreign ownership of businesses and property.

Led by the Ministry of Commerce and the Department of Special Investigation (DSI), authorities are investigating and prosecuting foreigners and Thai nominees, with penalties that can include up to three years in prison and fines of up to one million baht.

The crackdown is particularly relevant in major foreign property and tourism markets including Bangkok, Pattaya, Phuket, Hua Hin, Koh Samui and Koh Phangan.

So what does this mean for foreign property owners who may already be using a nominee structure?

* Siam Venture Capital — SVC: An offshore lending platform providing financing for new buyers and loans for eligible owners converting from nominee structures.
